1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of Lifemory’s websites, QR plaque services, memorial pages, and related products (the "Services"). By using the Services, you agree to be bound by these Terms.

2. Definitions

• "Lifemory", "we", "us" means the Lifemory entity operating the Services.
• "User", "you" means any person or entity using the Services, including purchasers, memorial page owners, and visitors.
• "Memorial Content" means photos, videos, audio, texts, and other materials uploaded to a memorial page.
• "Partners" means local collaborators who provide customer support in their native language on behalf of Lifemory.

3. Eligibility & Accounts

You must be at least 16 years old to use the Services. Creating an account may be required for certain features.

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities under your account.
• Provide accurate, complete, and current information and keep it updated.

4. Orders, Pricing & Payment

• All prices are shown inclusive/exclusive of taxes as indicated at checkout and may vary by country.
• We reserve the right to change prices and correct any pricing errors.
• Payment is processed via approved payment providers. Your order is accepted once we confirm it.
• Custom products (e.g., ceramic QR plaques) are produced based on the information you provide.
• You are responsible for ensuring correctness of names, dates, links, and other custom fields.

5. Shipping & Delivery

• Digital services (the online memorial page, the digital QR code) are activated and delivered instantly online, immediately after payment confirmation — no physical shipping is required.
• Physical products (QR plaques) are dispatched within 3-5 business days of payment confirmation, via express courier, to the address provided at checkout. Actual delivery may take additional time depending on destination and possible customs or carrier delays.
• Risk of loss passes to you upon delivery to the carrier, where permitted by applicable law.
• Please inspect packages upon receipt and notify us promptly of any issues.

6. Returns, Replacements & Refunds

• Personalized or custom products may be non-returnable except in case of defects or damage on arrival.
• For defective items, contact us within the timeframe stated on the website to arrange repair or replacement.
• We may request photos or further details to assess your claim.
• Refunds (where applicable) are processed to the original payment method.

7. Memorial Content Policy

• You must own the rights to the content you upload or have permission to use it.
• Do not upload unlawful, defamatory, hateful, harassing, violent, or sexually explicit material.
• Do not upload content that infringes intellectual property or privacy rights.
• We may remove or disable content that violates these Terms or applicable law.
• You grant Lifemory a non-exclusive, worldwide, royalty-free license to host, display, and process the content for the purpose of providing the Services.

8. Intellectual Property & License to Use the Services

• The Services, including software, design, and trademarks, are owned by Lifemory or its licensors and are protected by law.
• Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services.
• You may not reverse-engineer, decompile, or attempt to extract source code except where permitted by law.

9. Partners, Referrals & Commissions

• Lifemory may collaborate with local Partners who assist users via phone or chat in the local language.
• Commissions are calculated according to the Partner agreement applicable in the Partner’s territory.
• Partners must follow brand guidelines, content policies, and provide accurate information to customers.
• Misuse, fraud, or breach of policy may result in suspension or termination of Partner status.

10. Hosting Plans, Renewals & Cancellation

• Memorial hosting plans may be one-time (lifetime/long-term) or subscription-based, as described on the website.
• For subscriptions, recurring charges apply until cancelled. You can cancel via your account or by contacting support.
• Upon cancellation or non-payment, access to certain features may be limited or suspended.

11. Suspension & Termination

• We may suspend or terminate access for violations of these Terms, suspected fraud, or illegal behavior.
• We may preserve or disclose information if required by law or to protect rights, safety, or property.

12. Warranties

Except as expressly stated, the Services and products are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Lifemory shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or other intangible losses arising from your use of the Services.

14. Indemnification

You agree to defend, indemnify, and hold harmless Lifemory and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your misuse of the Services.

15. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control, including natural disasters, war, labor disputes, internet or utility failures, or changes in laws.

16. Governing Law

These Terms are governed by the laws of Romania and, where applicable, EU law, without regard to conflict of laws principles.

17. Dispute Resolution

Disputes shall be subject to the competent courts in Romania, unless mandatory consumer protection laws in your country grant you other rights.

18. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this page with the effective date.
