Terms and Conditions

Lifemory is the brand under which TOP GUIDE S.R.L. (tax ID CIF 54815518, trade register no. J2026036188000, share capital 200 lei, registered office and place of business at Str. Calea Roșiori nr. 104, Sat Văcărești, Comuna Drăgănești de Vede, jud. Teleorman, 147132, România) sells the products and services on lifemory.eu. In these Terms, “Lifemory”, “we”, “us” or “the seller” means TOP GUIDE S.R.L..

• Services – the lifemory.eu website, digital memorial pages, QR code plaques and other products, and related features.
• User or you – anyone who uses the Services, including buyers, memorial page owners and visitors.
• Consumer – an individual buying for purposes outside their trade, business or profession.
• Memorial content – photos, videos, audio recordings, texts and other material uploaded to a memorial page.

These Terms apply to your use of the Services and to every order placed on lifemory.eu. You must be at least 16 years old to use the Services and have full legal capacity to place an order.

• Keep your account login details confidential.
• You are responsible for activity carried out through your account.
• Provide accurate information and keep it up to date.

• The product page and your basket show the main characteristics of the product, the final price, the delivery cost (free) and the delivery time.
• You place your order using the final order button, which makes clear that placing the order involves an obligation to pay.
• The contract is concluded when you receive our order confirmation by email. The confirmation contains your order details; these Terms remain available on this page at all times.
• Physical products are made from the memorial page you create. You are responsible for the accuracy of the information you enter.

• Prices shown are final prices, in the currency shown at checkout. TOP GUIDE S.R.L. is not registered for VAT, so prices do not include VAT.
• Delivery is free and is made only to the European Union member states listed in our Shipping Policy.
• Payment is made online by card through the payment processor Stripe. We do not store your card details.
• If a price is shown with an obvious error, we will tell you before shipping and you may either confirm the order at the correct price or cancel it and receive a full refund.

• The digital memorial page goes live online as soon as payment is confirmed.
• Physical products are made within 3–5 business days and delivered by courier; transit times by zone, countries and conditions are set out in our Shipping Policy.
• The risk of loss or damage passes to you when you (or a person you have designated, other than the courier) take physical possession of the product.
• If we do not deliver within 30 days of the contract being concluded, you may terminate the contract and receive a full refund.

Physical products carry a unique QR code and are made to your specifications, so the 14-day right of withdrawal does not apply to them (Article 16(c) of Directive 2011/83/EU). For the digital service, you lose the right of withdrawal only if you expressly requested at checkout that the service start immediately. Full details, including the procedure for faulty products and refunds, are in our Returns Policy.

Products are covered by the 2-year legal guarantee of conformity from delivery (Directive (EU) 2019/771; Romanian Government Emergency Ordinance No. 140/2021), and the digital memorial page by the legal guarantee for digital content and services (Directive (EU) 2019/770; Ordinance No. 141/2021). In addition, the ceramic plaque comes with a 25-year commercial warranty, described on our Warranty page. The commercial warranty does not affect your statutory rights.

• We do not sell subscriptions or charge recurring fees. Paid plans are paid once.
• The free plan provides a memorial page with the features described on the pricing page, without a physical product.
• The memorial page stays online for life. If the service were ever to close, we will tell you at least 6 months in advance and provide a complete copy of the page (photos, texts, videos).

• Only upload content you own or have permission to use, including the consent of living people who appear in photos or texts.
• Do not upload content that is unlawful, defamatory, hateful, harassing, violent or sexually explicit, or that infringes the rights of others.
• We may remove or disable content that breaches these Terms or the law, and we will tell you why.
• You grant us a non-exclusive, free licence, valid for as long as the content is published, solely to host, display and process the content in order to provide the Services. The content remains yours.

The website, application, design and the Lifemory brand belong to TOP GUIDE S.R.L. or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services in accordance with these Terms. You may not copy, decompile or extract the source code, except where the law allows it.

We may work with partners (for example, funeral service providers) who recommend the Services. Partners are not our agents and cannot change these Terms; the contract of sale is always concluded directly with TOP GUIDE S.R.L..

• We may suspend or close an account in the event of a serious breach of these Terms, fraud or unlawful activity, and will tell you the reason.
• You can close your account at any time from your account or by emailing support@lifemory.eu. Data is deleted in line with our Privacy Policy.
• We may retain or disclose information where the law requires us to.

We are liable for performing our contractual obligations in accordance with the law. We are not liable for damage caused by use of the Services contrary to these Terms or by content uploaded by users. Nothing in these Terms limits our liability for damage caused intentionally or through gross negligence, for death or personal injury, or the rights the law gives consumers.

We are not liable for delays or failures caused by force majeure events (for example natural disasters, war, or widespread internet or courier outages). We will inform you as soon as possible, and if the delay exceeds 30 days you may terminate the contract and receive a full refund.

These Terms are governed by Romanian law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of your country of residence. Disputes are resolved amicably or by the competent courts; as a consumer, you may also bring proceedings in the courts where you live.

You can also contact the ANPC (Romanian consumer authority), including its ADR procedure, and, if you live in another EU country, the European Consumer Centre in your country (ECC-Net).

We may update these Terms. The new version is published on this page with its effective date. Each order is governed by the version in force when it was placed.
